Important Notice: My Maintenance Pro is a property maintenance management tool only. It does not replace the need for licensed tradespeople or professional contractors. All remedial, repair, compliance, and safety work must be carried out by appropriately licensed and qualified professionals.
Please read these Terms of Service carefully before using My Maintenance Pro. By accessing or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.
1. About My Maintenance Pro
My Maintenance Pro is a property maintenance tracking and management platform operated by ESJ Property Trust (“we”, “us”, “our”). The App is designed to help property owners, landlords, property managers, and contractors track, schedule, and record property maintenance and inspection activities.
2. Nature of the App — Not Professional Advice

My Maintenance Pro is a management and tracking tool only. Nothing within the App constitutes professional advice of any kind, including but not limited to:

  • Building, structural, or engineering advice
  • Electrical, plumbing, gas, or mechanical advice
  • Legal, compliance, or regulatory advice
  • Safety, fire, or emergency management advice
  • Financial, insurance, or investment advice

The App provides general maintenance tracking frameworks based on commonly accepted property maintenance practices. These frameworks are guides only and must not be relied upon as a substitute for professional assessment.

3. Licensed Trades and Professional Contractors

You expressly acknowledge and agree that:

  • All physical inspection, repair, remediation, installation, or compliance work on any property must be carried out by appropriately licensed, qualified, and insured tradespeople or contractors
  • The App’s inspection checklists, reminders, and maintenance schedules do not replace mandatory statutory inspections required by law
  • Certificate data entered into the App does not constitute verification of compliance — only the issuing licensed trade or authority can confirm compliance
  • No inspection item rating within the App (Good, Average, or Poor) constitutes a professional assessment or safety certification
  • You are solely responsible for engaging appropriately licensed professionals for all trades work on your property
4. Limitation of Liability

To the maximum extent permitted by applicable law, ESJ Property Trust, My Maintenance Pro, and their respective directors, officers, employees, agents, and contractors expressly disclaim all liability for:

  • Any loss, damage, injury, or death arising from reliance on information provided within the App
  • Any failure to carry out maintenance, inspections, or repairs identified through the App
  • Any inaccuracy, incompleteness, or unsuitability of inspection templates, checklists, or maintenance schedules for your specific property
  • Any regulatory non-compliance arising from use or non-use of the App
  • Any damage to property or persons arising from work carried out based on App data
  • Any loss of data, interruption of service, or technical failure of the App
  • Any indirect, incidental, consequential, special, or punitive damages of any kind

Where liability cannot be excluded by law, our total liability to you for any claim is limited to the amount you paid for the App in the 3 months preceding the claim.

5. Your Responsibilities

As a user of My Maintenance Pro you agree to:

  • Use the App as a management tool only, not as a substitute for professional trades or expert advice
  • Engage licensed and qualified tradespeople for all physical work on your property
  • Comply with all applicable laws, regulations, and standards relevant to your property
  • Ensure all information you enter into the App is accurate to the best of your knowledge
  • Not share your account credentials with unauthorised persons
  • Keep your contact and billing information up to date 
6. Subscription and Billing

Access to certain features of My Maintenance Pro requires a paid subscription. By subscribing you agree to:

  • Pay all applicable fees as described at the time of subscription
  • Recurring monthly charges until you cancel your subscription
  • No refunds for partial subscription periods unless required by applicable consumer law
  • Price changes taking effect at the next billing cycle with reasonable prior notice
7. Intellectual Property
All content, features, functionality, trademarks, and intellectual property within My Maintenance Pro are owned by ESJ Property Trust and are protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our express written consent.
8. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms. You may cancel your subscription at any time through the App settings or by contacting us at support@mymaintpro.com

10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
